Nanny Holiday Pay
Almost all employees, including nannies, housekeepers and domestic staff have the right to the statutory amount of paid annual leave, in other words the minimum legal holiday entitlement. This should be included in the nanny’s contract of employment which should be provided before their nanny placement with your family commences. The nanny’s holiday entitlement will vary depending on the number of days an employee works. Nannies will accrue holiday from the first day their job starts. This includes during the probationary period, on sick leave or paternity and maternity leave.

Holiday Entitlement for Full time Employees - How much holiday is my Employee entitled to?
If you hire a full-time nanny or housekeeper who works 5 days a week they are entitled to a minimum statutory holiday allowance of 28 days holiday per annum. This is made up of 20 holiday days (4 weeks) and 8 bank holidays. This is the equivalent of 5.6 weeks of holiday. If you would like to exclude bank holidays from the allowance in your nannie’s contract, this is the equivalent of 20 days per calendar year.
If your nanny or housekeeper works more than 5 days per week, their legal minimum holiday entitlement remains at 5.6 weeks per annum. This is the statutory minimum entitlement that almost all employees are entitled to. This includes agency workers, zero contract hours workers and also nannies with irregular working hours.
If your nanny started working for you part way through the year the holiday allowance will be prorated. A good rule of thumb is that holiday accrues at a rate of 2.3 days per month (this accrual rate includes bank holidays). If your nanny wants to take more holiday than they have accrued, this is up to you to decide.
If the employment contract ends, any holiday they have taken that is more than their accrual can be deducted from the final payslip. However, it is also important to remember that any holiday that the nanny has not taken by the end of the employment should be added to their final payslip.

Holiday entitlement for part-time nannies - How much holiday is my nanny entitled to if he/she does not work full time?
If you hire a part-time nanny who works less than 5 days a week they are still entitled to holiday pay. This will simply be pro-rated (reduced in proportion to the number of days worked). The Little Ones Payroll team can help you calculate this allowance. Please see the below calculations for part-time nannies.
- An employee working 4 days a week will be entitled to 4 x 5.6 days of holiday per annum = 22.4 days (including bank holidays).
- An employee working 3 days a week will be entitled to 3 x 5.6 days of holiday per annum = 16.8 days (including bank holidays).
- An employee working 2 days a week will be entitled to 2 x 5.6 days of holiday per annum = 11.2 days (including bank holidays).
**For a nanny’s holiday allowance that is less than a full day and includes a part-day, for example, 22.4 days, you cannot choose to round down the number. A sensible compromise to account for this part day would be to agree to come in late or early on one of the nanny’s days of work.
Holiday Entitlement for Term time nannies
Nannies who only work during term time will also be entitled to paid holiday allowance. This will simply be prorated based on the number of weeks worked.

Additional Leave
Employers can choose to offer more leave than the statutory legal allowance. However, this must be detailed in the contract of employment.
Unused holiday allowance – Final payslips
If your nanny stops working for you, you must remember to include any unused holiday allowance for the time the employee worked for you in the final payslip. This can be tricky to calculate, and the Little Ones Payroll team would be delighted to help you work this out. Please do not hesitate to contact a member of the team with any questions.
Specifying when an employee can take Annual Leave
This should be carefully detailed in your contract of employment so that employers can plan if a nanny or housekeeper is taking annual leave. If there’s no agreement in place, your nanny must give notice of at least twice the length of the time they want to take off.
If a nanny wants to take more holiday than is in the contract, this would be unpaid.

Verify that your nanny is legally permitted to work in the UK
Simply check an ID document (e.g. passport or visa.)
Calculate your overall cost by agreeing on a gross salary.
