A statutory excuse is the concept implemented by the employer to verify whether their employee has the license to work in the UK. It is illegal for the employee if they work in the UK without any rights. It is also not appropriate for the employee who has no right to enter or reside within the country.

What happens if the Employer fails to check Employee ?
If the employer knows that the nanny hired does not have the legal right to work in the UK but still hires them, the employer will face legal action. It will be under the Race Relations Act. This offense will also be considered a criminal violation. The employer may end up paying an unlimited penalty payment and two years in prison. The employee also should pay the penalty for their illegal activity.
