Some people might not even know where to start the process of finding one or what they need to do once they have found a nanny or housekeeper. This is why we have provided an explanation of our Employer’s checklist of what you need to do to make sure that your nanny follows all the government guidelines.

 

The list is not only about making sure that you provide a contract and payslip to your nanny, but It’s also about being sure that your children are safe at home while you are out or at work. Confirming each of the steps you will find will protect your children, your house and your employee. Every person in the working relationship will be protected.

What do I need to check to hire a nanny, housekeeper, nanny-housekeeper or any domestic private staff?

The first thing we recommend anyone to do before hiring a nanny or housekeeper is to make sure that the person has the right to work in the UK or in the country the employee will be working in.

You need to bear in mind that if you are going to hire someone in the UK, showing a European passport is no longer enough proof of having the right to work because the UK is no longer part of the EU. Therefore, you will need to ask your nanny or housekeeper to show you a work visa, pre-settled or settled status, or any other document, like residence cards, that will allow the employee to work in the relevant country.

About the pre-settled and settled status, the Government has established that showing the letter they send to the person as proof of right to work is not acceptable to prove this. To be 100% sure that your future employee may work in the UK, you will need to check on https://www.gov.uk/prove-right-to-work 

Check work references, DBS check and Paediatric First Aid Certificate

Little Ones Payroll Service recommends that every family that is planning to hire a nanny, housekeeper or any private domestic staff check at least two verbal references of previous employment, that their future employee’s DBS is clean and if they will work with children, that they have a valid paediatric first aid certificate to make sure they know how to react in emergency situations.

This requirement is not a must, but will protect your family and children. It is important to know that the person that you are hiring knows how to correctly react in a situation where your children and home can be vulnerable. Checking employment references will, for example, let you know if what they told you in the interview about the reason why they left their last job is true. You are opening your most precious place to someone new, so knowing that they haven’t had any problem with the law, will help you to keep your family safe.

Employment Contract

Since April 6th 2000, anyone legally classed as an employee has the right to a written document that summarises their role and terms of employment. This includes nannies, housekeepers and staff that work within your home.

Nothing is better than having a complete and precise description of the job that the nanny, nanny-housekeeper or housekeeper will be doing every day. Employer & employee need to agree on the description before starting the job. In addition, you will need to discuss how many days and hours the nanny will come to your house, what the responsibilities of the nanny are, if they will be doing extra hours and how they will be paid, if the job is temporary or permanent, if the nanny needs to drive, and many other specifications.

Pension

Employee Auto-Enrolment is the process in which an employee is made a member of a pension scheme, as they have met certain eligibility requirements, without needing to ask to be part of it. If the nanny meets these minimum thresholds, they must automatically be enrolled into a pension scheme by their employer.

Auto-enrolment is a legal duty of the employer and if you do not meet these obligations, the Pensions Regulator may take certain enforcement actions, which may include a penalty fine. The legal responsibility for auto-enrolment sits with employers. 

Automatic enrolment duties apply from the day your new member of staff starts working for you.

Employment Payslip

If you are the employer, you are obliged to give your nanny, nanny-housekeeper or housekeeper a payslip; this is an employee’s right according to the Government official website- Gov.uk. What is a payslip? It’s a note that details the amount the employee has been paid for a specific period and lists any deductions, like PAYE, NI, student loans, and pension contributions. The payslip can be sent on paper by post or given directly to the employee or via email in digital format.

Holiday

Before your nanny, housekeeper or nanny-housekeeper starts working for you, you have the legal obligation to let your nanny or housekeeper know how many days of holiday they are entitled to.

If you hire a full-time nanny or housekeeper who works 5 days a week, they are entitled to a minimum statutory holiday allowance of 28 days holiday per annum. This is made up of 20 holiday days (4 weeks) and 8 bank holidays. This is the equivalent of 5.6 weeks of holiday.  If you would like to exclude bank holidays from the allowance in your nanny’s contract, this is the equivalent of 20 days per calendar year.

 

If you hire a part-time nanny who works less than 5 days a week, they are still entitled to holiday pay. This will simply be pro-rated (reduced in proportion to the number of days worked). The Little Ones Payroll team can help you calculate this allowance

Verify that your nanny is legally permitted to work in the UK

Simply check an ID document (e.g. passport or visa.)

Calculate your overall cost by agreeing on a gross salary.
